  3. BORLAND NO-NONSENSE LICENSE STATEMENT AND LIMITED WARRANTY
  4.  
  5. Borland grants you the right to use this Borland software
  6. product ("Software"), including any accompanying
  7. documentation, in the manner provided below.
  8.  
  9. This Software is owned by Borland or its suppliers and is
  10. protected by copyright law and international copyright
  11. treaty. Therefore, you must treat this Software like any
  12. other copyrighted material (e.g., a book), except that you
  13. may either make one copy of the Software solely for backup
  14. or archival purposes or transfer the Software to a single
  15. hard disk provided you keep the original solely for backup
  16. or archival purposes.
  17.  
  18. You may transfer the Software and documentation on a
  19. permanent basis provided you retain no copies and the
  20. recipient agrees to the terms of this license statement.
  21. Except as provided in this statement, you may not transfer,
  22. rent, lease, lend, copy, modify, translate, sublicense, time-
  23. share or electronically transmit or receive the Software,
  24. media or documentation.  You acknowledge that the Software
  25. in source code form remains a confidential trade secret of
  26. Borland and/or its suppliers and therefore you agree not to
  27. modify the Software or attempt to decipher, decompile,
  28. disassemble or reverse engineer the Software, except to the
  29. extent applicable laws specifically prohibit such
  30. restriction.

  32. If you have purchased an upgrade version of the Software, it
  33. constitutes a single product with the Borland software that
  34. you upgraded. You may use or transfer the upgrade version of
  35. the Software only in accordance with this license statement.

  37. This Software is subject to U.S. Commerce Department export
  38. restrictions, and is intended for use in the country into
  39. which Borland sold it (or in the EEC, if sold into the EEC).

  41. ADDITIONAL LICENSE TERMS FOR BORLAND VISUAL dBASE 7 Borland
  42. grants to you as an individual, a personal, nonexclusive
  43. license to install and use the Software for the sole
  44. purposes of designing, developing, testing, and deploying
  45. application programs which you create.  You may install a
  46. copy of the Software on a computer and freely move the
  47. Software from one computer to another, provided that you are
  48. the only individual using the Software.  If you are an
  49. entity, Borland grants you the right to designate one
  50. individual within your organization ("Named User") to have
  51. the right to use the Software in the manner provided above.

  53. GENERAL TERMS THAT APPLY TO COMPILED PROGRAMS AND
  54. REDISTRIBUTABLES You may write and compile your own
  55. application programs using the Software, including any
  56. libraries and source code included for such purpose with the
  57. Software. You may reproduce and distribute, in executable
  58. form only, programs which you create using the Software
  59. without additional license or fees, subject to all of the
  60. conditions in this statement.

  62. Borland products may include certain files
  63. ("Redistributables") intended for distribution by you to the
  64. users of programs you create. Redistributables include, for
  65. example, those files identified in the accompanying printed
  66. or on-line documentation as redistributable files, those
  67. files preselected for deployment by an install utility
  68. provided with the Software (if any), or those files pre-
  69. selected by a third party install utility which operates
  70. under control of an install script which Borland has
  71. certified (if any) for use by licensed users of this
  72. Software for deploying applications.  In any event, the
  73. Redistributables for the Software are only those files
  74. specifically designated as such by Borland.  From time to
  75. time, Borland may designate other files as Redistributables.
  76. You should refer to the documentation, including any
  77. "readme" or "deploy" files included with the Software, for
  78. additional information.

  80. Subject to all of the conditions in this statement, you may
  81. reproduce and distribute exact copies of the
  82. Redistributables, provided that such copies are made from
  83. the original copy of the Software or the copy transferred to
  84. the single hard disk.  Copies of Redistributables may only
  85. be distributed with and for the sole purpose of executing
  86. application programs permitted under this statement that you
  87. have created using the Software.  Under no circumstances may
  88. any copies of Redistributables be distributed separately.
  89. Only you as the Named User have the right to use the
  90. Redistributables for developing programs created with the
  91. Software; accordingly, you may not share copies of the
  92. Redistributables with other co-developers.  You may not
  93. reproduce or distribute any Borland documentation without
  94. Borland's permission.

  96. The license granted in this statement for you to create your
  97. own compiled programs and distribute your programs and the
  98. Redistributables (if any) is subject to all of the following
  99. conditions:  (i) all copies of the programs you create must
  100. bear a valid copyright notice, either your own or the
  101. Borland copyright notice that appears on the Software;  (ii)
  102. you may not remove or alter any Borland copyright, trademark
  103. or other proprietary rights notice contained in any portion
  104. of Borland libraries, source code, Redistributables or other
  105. files that bear such a notice;  (iii) Borland provides no
  106. warranty at all to any person, other than the Limited
  107. Warranty provided to the original purchaser of the Software,
  108. and you will remain solely responsible to anyone receiving
  109. your programs for support, service, upgrades, or technical
  110. or other assistance, and such recipients will have no right
  111. to contact Borland for such services or assistance; (iv) you
  112. will indemnify and hold Borland, its related companies and
  113. its suppliers harmless from and against any claims or
  114. liabilities arising out of the use, reproduction or
  115. distribution of your programs;  (v) your programs must be
  116. written using a licensed, registered copy of the Software;
  117. (vi) your programs may not be merely a set or subset of any
  118. of the libraries, code, Redistributables or other files of
  119. the Software; and (vii) you may not use Borland's or any of
  120. its suppliers' names, logos, or trademarks to market your
  121. programs, except to state that your program was written
  122. using the Software.

  124. All Borland libraries, source code, Redistributables and
  125. other files remain Borland's exclusive property.  Regardless
  126. of any modifications that you make, you may not distribute
  127. any files (particularly Borland source code and other non-
  128. executable files) except those that Borland has expressly
  129. designated as Redistributables.  Nothing in this license
  130. statement permits you to derive the source code of files
  131. that Borland has provided to you in executable form only, or
  132. to reproduce, modify, use, or distribute the source code of
  133. such files.  You are not, of course, restricted from
  134. distributing source code that is entirely your own.  Code
  135. which you generate with a Borland code generator, such as
  136. AppExpert, is considered by Borland to be your code.

  138. ADDITIONAL LICENSE TERMS FOR BORLAND DATABASE ENGINE You may
  139. not redistribute any program which includes Redistributables
  140. of the Software identified as BORLAND DATABASE ENGINE ("BDE
  141. Redistributables") that is a general purpose database
  142. program or otherwise generally competitive with or a
  143. substitute for Borland's Paradox, dBASE, or the Borland
  144. Database Engine. Your programs must require your users to
  145. run an unmodified copy of the installation program created
  146. by the install utility provided with the Software (if any),
  147. or created by a third party install utility which operates
  148. under control of an install script which Borland has
  149. certified for deploying applications using the BDE
  150. Redistributables.  Further, you may not redistribute a
  151. subset of the BDE Redistributables or circumvent any
  152. integrity and/or versioning checks required for correctly
  153. installing the BDE Redistributables.
  154.  
  155. LIMITED WARRANTY Except with respect to the
  156. Redistributables, which are provided "as is," without
  157. warranty of any kind, Borland warrants that the Software, as
  158. updated and when properly used, will perform substantially
  159. in accordance with the accompanying documentation, and the
  160. Software media will be free from defects in materials and
  161. workmanship, for a period of ninety (90) days from the date
  162. of receipt. Any implied warranties on the Software are
  163. limited to ninety (90) days.  Some states/jurisdictions do
  164. not allow limitations on duration of an implied warranty, so
  165. the above limitation may not apply to you.
  166.  
  167. BorlandÆs and its suppliersÆ entire liability and your
  168. exclusive remedy shall be, at BorlandÆs option, either (a)
  169. return of the price paid, or (b) repair or replacement of
  170. the Software that does not meet BorlandÆs Limited Warranty
  171. and which is returned to Borland with a copy of your
  172. receipt.  DO NOT RETURN ANY PRODUCT UNTIL YOU HAVE CALLED
  173. THE BORLAND CUSTOMER SERVICE DEPARTMENT AND OBTAINED A
  174. RETURN AUTHORIZATION NUMBER.  This Limited Warranty is void
  175. if failure of the Software has resulted from accident,
  176. abuse, or misapplication.  Any replacement Software will be
  177. warranted for the remainder of the original warranty period
  178. or thirty (30) days, whichever is longer.  Outside the
  179. United States, neither these remedies nor any product
  180. support services offered by Borland are available without
  181. proof of purchase from an authorized non-U.S. source.
  182.  
  183. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BORLAND
  184. AND ITS SUPPLIERS DISCLAIM ALL OTHER WARRANTIES, EITHER
  185. EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO,  IMPLIED
  186. WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
  187. PURPOSE AND WARRANTIES OF NONINFRINGEMENT, WITH REGARD TO
  188. THE SOFTWARE AND THE ACCOMPANYING DOCUMENTATION. THIS
  189. LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS.  YOU MAY
  190. HAVE OTHERS, WHICH VARY FROM STATE/JURISDICTION TO
  191. STATE/JURISDICTION.

  193. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO
  194. EVENT SHALL BORLAND OR ITS SUPPLIERS BE LIABLE FOR ANY
  195. DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES
  196. FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF
  197. BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING
  198. OUT OF THE USE OF OR INABILITY TO USE THIS BORLAND PRODUCT,
  199. EVEN IF BORLAND HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  200. DAMAGES.  BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE
  201. EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR
  202. INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO
  203. YOU.

  205. HIGH RISK ACTIVITIES The Software is not fault-tolerant and
  206. is not designed, manufactured or intended for use or resale
  207. as on-line control equipment in hazardous environments
  208. requiring fail-safe performance, such as in the operation of
  209. nuclear facilities, aircraft navigation or communication
  210. systems, air traffic control, direct life support machines,
  211. or weapons systems, in which the failure of the Software
  212. could lead directly to death, personal injury, or severe
  213. physical or environmental damage ("High Risk Activities").
  214. Borland and its suppliers specifically disclaim any express
  215. or implied warranty of fitness for High Risk Activities.
  216.  
  217. U.S. GOVERNMENT RESTRICTED RIGHTS The Software and
  218. documentation are provided with RESTRICTED RIGHTS.  Use,
  219. duplication, or disclosure by the Government is subject to
  220. restrictions as set forth in subparagraphs (c)(1)(ii) of the
  221. Rights in Technical Data and Computer Software clause at
  222. DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the
  223. Commercial Computer Software-Restricted Rights at 48 CFR
  224. 52.227-19, as applicable.  Manufacturer is Borland
  225. International, Inc., 100 Borland Way, Scotts Valley, CA
  226. 95066.

  228. GENERAL PROVISIONS This statement may only be modified in
  229. writing signed by you and an authorized officer of Borland.
  230. If any provision of this statement is found void or
  231. unenforceable, the remainder will remain valid and
  232. enforceable according to its terms.  If any remedy provided
  233. is determined to have failed for its essential purpose, all
  234. limitations of liability and exclusions of damages set forth
  235. in the Limited Warranty shall remain in effect.

  237. This statement shall be construed, interpreted and governed
  238. by the laws of the State of California, U.S.A.  This
  239. statement gives you specific legal rights; you may have
  240. others which vary from state to state and from country to
  241. country.  Borland reserves all rights not specifically
  242. granted in this statement.
